Terms of Service - Fillable Forms

1. Acceptance of terms

By accessing or using Fillable ("the Service"), operated by Err Nerr at fillable.dev, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of service

Fillable is a web-based form builder that allows users to create, publish, and embed forms on websites. The Service includes a free tier with 100 form submissions, and optional paid credit packs for additional submissions.

3. Accounts

You must be at least 13 years old to create an account.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate and complete information when registering.
You may not share your account with others or use another person's account without permission.

4. Free tier and credits

New accounts receive 100 free form submissions at no charge.
Additional submissions can be purchased as credit packs. Credits do not expire.
Prices are listed in GBP and are inclusive of applicable taxes unless stated otherwise.
All purchases are processed via Stripe. By purchasing, you agree to Stripe's terms of service.
Credit packs are non-refundable once purchased, except where required by applicable law.

5. Acceptable use

You agree not to use Fillable to:

Collect data without the knowledge or consent of form respondents.
Create forms designed to deceive, defraud, or phish users.
Collect or process sensitive personal data (e.g. payment card numbers, passwords) directly through Fillable forms.
Violate any applicable law, regulation, or third-party rights.
Distribute spam, malware, or other harmful content.
Attempt to gain unauthorised access to other accounts or our systems.
Resell or sublicense the Service without our written consent.

6. Your content

You retain ownership of all forms, content, and data you create or collect through Fillable. By using the Service, you grant Fillable a limited licence to host, store, and display your content solely as necessary to provide the Service. You are solely responsible for ensuring your use of Fillable complies with applicable data protection laws (including UK GDPR) in relation to any personal data collected through your forms.

7. Data protection

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. As a form owner, you are the data controller for any personal data collected through your forms; Fillable acts as data processor on your behalf.

8. Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. We reserve the right to perform maintenance, updates, or temporary outages. We will endeavour to notify users of planned downtime in advance where possible.

9. Termination

You may delete your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Limitation of liability

To the fullest extent permitted by law, Fillable and Err Nerr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months prior to the claim.

11. Changes to these terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
